What is the status of the Roundup lawsuit?

What is the Roundup lawsuit history?

  • The first Bayer Roundup lawsuit went to trial in 2018. Johnson v. Monsanto, 52 Cal.App.5th 434 (Cal. Ct. App. 2020) resulted in a $20.5 million verdict in favor of the plaintiff. The claim involved a 46-year-old groundskeeper who sprayed the herbicide while working as a groundskeeper at various schools.
  • The second trial heard by a jury was Hardeman v. Monsanto, Nos. 19-16636, 19-16708, (9th Ct. App.). After a jury verdict, the 9th Circuit Court of Appeals upheld compensation for the victim in the amount of $25.2 million. The basis of the claim was that the company failed to warn of the dangers that may occur from exposure to the product.
  • A third trial, Pilliod v. Monsanto¸A158228 (Cal. Ct. App.) also went to appeal after a jury verdict in favor of the plaintiff. The court upheld an award of $87 million.
  • In September 2021, parties presented evidence in Donnetta Stephens v. Monsanto, (CGC-20-585764 / CIVSB2104801, 2020.) The victim was diagnosed with non-Hodgkins lymphoma after a lifetime of using the herbicide, including contact with her skin while using the product in windy conditions.

What legal issues are present in the Roundup lawsuit claims?

There are two main legal questions in the Roundup lawsuit claims – defective product claims and failure to warn allegations. The defective product claim is simply that the company made a harmful product. The failure to warn claim is that the company did not take sufficient steps to warn users about dangers relating to the product and safe handling procedures. A victim may pursue their claim based on both legal theories.

The courts have disagreed about the availability of the failure to warn legal theory. The Hardeman court allowed it – and it resulted in a verdict in the plaintiff’s favor. However, the Stephens court refused to allow failure to warn arguments, saying that federal EPA warning label approvals pre-empted state laws. Nevertheless, the Pilliod case addressed the issue on appeal. The appeals court ruled in favor of the plaintiffs, allowing the failure to warn argument, and creating a binding precedent for future cases.

Roundup is the most-used herbicide in the world. Monsanto developed seeds that were resistant to the active ingredient glyphosate. Then, users could spray the herbicide to kill the weeds around the crops they intended to grow. However, glyphosate may also cause cancer in the form of non-Hodgkin’s lymphoma.

Non-Hodgkin’s lymphoma is a condition where the body creates too many abnormal white blood cells. Symptoms may include:
