- A third trial, Pilliod v. Monsanto¸A158228 (Cal. Ct. App.) also went to appeal after a jury verdict in favor of the plaintiff. The court upheld an award of $87 million.
- In September 2021, parties presented evidence in Donnetta Stephens v. Monsanto, (CGC-20-585764 / CIVSB2104801, 2020.) The victim was diagnosed with non-Hodgkins lymphoma after a lifetime of using the herbicide, including contact with her skin while using the product in windy conditions.
What legal issues are present in the Roundup lawsuit claims?
There are two main legal questions in the Roundup lawsuit claims – defective product claims and failure to warnallegations. The defective product claim is simply that the company made a harmful product. The failure to warn claim is that the company did not take sufficient steps to warn users about dangers relating to the product and safe handling procedures.
