No Fee Unless You Win

Most drivers assume the other person’s insurance covers everything after a crash. When the at-fault driver carries no insurance, that assumption can cost thousands of dollars. At Walton Telken Bragee Injury Attorneys, our Motor Vehicle Accidents lawyers see this situation regularly, and the drivers who struggle most are the ones who never knew what protection they had, or did not have, until it was too late.
Many drivers never ask, “What is uninsured motorist property damage?” until after a crash. Getting that answer now puts you in a position to make smarter decisions and protect what you own.
In Illinois, Uninsured Motorist Property Damage, or UMPD, represents an optional coverage drivers may add to their auto insurance policy. As the Illinois Department of Insurance explains, UMPD covers damage to your vehicle caused by an identified, at-fault, uninsured driver, and Illinois law requires insurers to offer this protection with a maximum $250 out-of-pocket deductible. Two details deserve attention here:
Filing a UMPD claim in Illinois means working with your own insurance company rather than chasing the at-fault driver for payment. Under 215 ILCS 5/143a, Illinois law limits UMPD recovery to the actual cash value of your vehicle or your policy limit, whichever is less, minus your deductible. When you file against an identified, at-fault uninsured driver, your insurer covers repairs or pays out your car’s actual cash value if the damage goes beyond repair.
Two exclusions matter here. UMPD does not cover medical bills or lost wages, which require a separate bodily injury claim. Insurers may also exclude loss of use of your vehicle and any personal property inside it at the time of the crash. Filing the wrong claim type can slow your recovery and leave money on the table.

Edwardsville sits in Madison County, a busy corridor connecting the St. Louis metro area to communities throughout southwestern Illinois.
